Hi guys, I need some advice with a warranty issue for my xr6 turbo ute. I booked it into ford a week ago for warranty inspection of the tailgate as one of the latches has broken. It is being seen tomorrow. Today while I was driving I hit a small bump and the tailgate flew open, it managed to disconnect itself from the cable struts and landed on the towball leaving a big dent in the tailgate.

My question is, do I have a leg to stand on if I want ford to fix the dent due to the damage being caused by a faulty part? I'm sure im not the first person to be in this sort of situation.

Is not damage caused through fair wear and tear so should be covered, I know I'd certainly be having a tantrum or two until it's fixed at no cost to me.

One of those latches (similar to what you would find on a door) has broken and is now presumably floating around in the tailgate somewhere. Also the return spring for the handle, so you have to acually push it back to close it.

I'm assuming the safety cable disconnected because the tailgate came down and was caught the first time, but when it bounced up it put pressure back onto the cable which allowed them to slip off. Then it came all the way down the second time onto the tailgate. There was no damage to the cables or any of it's fittings.
