Talk to consumer affairs. Maintenance item with no published service interval is horse sh*t.

Sounds like they can pull that excuse on any part.

"Your gearbox crossmember broke? That's a service item!"

What a load of crap.

I actually think that having put that in writing is a mistake on their part and will mean you will win in the long term.

Have you modded car?

Ford says you mod you void warranty.

So you couldn't do a mod to prevent this under Ford.

Ford have paid out to people with mods for same thing.

Ask for examples of this from members, date times etc when done.

Get armed with information.

Let them keep talking the more they talk the more mistakes they're likely to make. Particularly if you keep the pressure on them, and even better if its in writing!

Don't let them get you on this!

Every communication about it, whether written, email, txt -- whatever -- needs to be in writing.

I (and this is just me), I wouldn't even talk to the Fraud Service Dept without it being video'd or something.

While this is a bit off topic, it's worth mentioning because so many people do not understand how this works...

Just remember that only mods which cause a problem will void your warranty on the affected parts.

If you have 400rwkw and break your tailshaft they have a point that your mods caused the problem and knocking back a claim for a replacement tailshaft would be fair enough.

If you have 400rwkw and your paint falls off, the mods are irrelevant and they would still have to fix the paint.

That's correct.

Have a look at the reply's from Ford, they are clutching at straws already with that statement.

If OP had mod's, I put money on it they would say sorry cars modded to try and blow him off.

Being directly or indirectly modded.

I still think there is valve in Forum members starting a thread to collect Factual information about milkshake claims from Ford.

This would show possible inconsistency in claims, weakening there position.

If there has been one thing that I've learnt in tough negotiations, is to stay ahead of the game. You need to gathering your information before it needed, puts you in stronger position when the time comes.

You want to know the answer to the question before you ask any! :My 2cents:

Dont think the case is as strong as making a claim through proper Ford warranty...

I.e. perhaps the peeps who have successfully claimed new gearboxes were first owners with orignial ford warranty? But not 100% on that lol

Dept of fair trading or what ever they call themselves , I'd try them before I start paying lawyers, otherwise your just adding to the list of karnts you gotta deal with.

I was second owner, got it with 4000km odo, gearbox replaced at 9000km odo, not even questioned about obvious mods as it is a known fault caused by a factory item.

Cheers for the input and support guys.

To sum it up so far to reduce scrolling. Bought the car second hand, 3rd party warranty sold via Ford Dealer (manufactures wty had already run out).

3rd party warranty company are claiming g'box is consequential damage from the heat exchanger failure - Not going to pay for it. I went to Ford because they have serviced the car since I've had it (Twice in 11mths) and when mentioning g'box issues when being dropped off for the service. The report on the service sheet was "G'Box operation Normal". Ford Aust, aren't coming to the party because of the 3rd party wty. This is what they told me over the phone (note the letter doesn't reflect this!?). Currently collating resources to dispute it with the wty company. Failing this I'll raise the point that false info provided by the dealer to the wty company to A. Get the warranty B. Get the sale based on the supply of the warranty.

The dealer was selling the warranty product which makes them an agent of the Warranty company and making them ultimately responsible for false info provided to me to get a sale & sell me a void product on a signed contract. Which would be legally binding and require honoring or compensation :)

I won't be rolling over on this, I'm probably not the only one being screwed over by them either.
