Once the fine is passed down and your day in court is done, buy the car back for the same amount, and all should be well in the world again.Also, since he does have your history, if there are no drink driving offences, you can try and use that in your favor as well, saying to the magistrate that you can be slightly irresponsible at times, but never as bad enough as to drive under the influence of alcohol. It looks better than representing yourself even if you are taking the guilty plea, and it's all about looking good.Get some character references saying you are taking this very hard, it's damaging your personal life etc. a lawyer would have already told you this and helped you present yourself better. Mitigation is key. They start at bad and you have to work your way to the good side.Get any letters from any sort of community service you have done, football clubs, school canteens whatever.In 2011 I got done doing >352012 I got done doing >45 and lost license on the spot. A few months later I got caught driving suspended and had to front court. I spend a lot of time discussing my case with people in the know and trust ... They all agree , there is a lot of merit in presenting yourself well . However, all have said , that if you're able to represent yourself well and are confident and polite and make a real effort to explain your situation - the magistrate will listen - however , if represented , very often the magistrate will just stare at the ceiling , knowing it is all lip service .At the end, the magistrate is bound by precedence , and is guided as what is the minimum penalty . The magistrate does however have the flexibility to fine you what is deemed appropriate and under the given circumstances has the discretion to apply a heavy penalty.So my thoughts are to flock up, deliver a cause and effect , confirm that the said vehicle is no longer in my possession or process of , and then fingers crossed I just get the minimum penalty and fine .. Clearly matters of speeding are seen in a different light from that of yester year ... I pray to the big man upstairs , that the magistrate doesn't have to sit through a string of speeders before me , or worse a speeder whom was drunk and cause personal injury to a innocent third party Link to comment Share on other sites More sharing options...

Wahooooooo. Why would they want to have a GT cab??? , beats me, but I don't care . At least I now know during my penalty period , I can get my GT fix ... I curiosity asked why? He said with a grin ' have you seen the new penalties for driving under the influences of alcohol and drugs ? ' As my heart sunk , I said No!!!! Rushed home and checked the Web, and on first offence the penalty would be a lost of license for 12mths and $4000 fine and a second offence carrying a fine of $40,000!!!I am afraid that these sort of penalties will be transposed to those caught speeding , and fined for other infractions . Present and accounted for in front of the Magristrates' , prosecutor, and the general public ..In short , the Magistrate asked if I agreed with the prosecutors brief ? , I did . I was then advised , by pleading guilty to the charge , I was in line to receive as a minimum 12mth suspension .. I stated I understood and confirmed , I would again plead guilty . I was asked then asked whether I wished to have representation ? . I replied , I would represent myself , and I had no character reference to rely on. I was asked to be seated ... As the prosecutor , explained the brief in detail, my leg started to shake , as I thought it was possible I had taken the wrong route in my effort to mininmise the damage . I was then allowed the right of reply ..I stated my case , held my breath as I waited for the Magistrate to pass down his decision. The Magistrate stated he had taken in account my guilty plea, my account of the traffic infringement , and driving history , and pass the order to suspend my license for 12mths , pay court costs of $70 and a fine of $500 payable within 30 days .
