Anyone starts taking mechanics to court to cover a couple extra hours labour and expects mechanics to carry liability insurance for said happenings.. Well those people can expect a serious beat down when thousands of others gets pissed off our labour rates for mechanics doubles..

Edit: in my books liability ends where faults are pre existing..

Example:

1. Your broken oil cap.. If the mech didn't attempt to open it with a big fuggin wrench and it broke in his hand.. It's brittle.. It's your problem and cost..

2. Bonnet release cable - fair wear and tear.. You wear the cost if you can't claim it on warranty (this happened to me.. Mechanic rang me up and said he could pop the bonnet using a pair of pliers on the cable and I could replace the cable myself if I wanted)

3. Cam shaft alteration on a car.. Mechanic accidentally releases the gas from the aircon system.. Buck stops with him.. He could have avoided it but he f*cked up..

It depends on circumstance.

It failed as a result of what would be considered fair wear and tear.

Unless the mechanic was wilfully destructive in removing your oil cap then there is no liability.

Call everyone simple minded and ignorant as much as you want buddy...but it appears the issue is that you're not hearing the answer that you want which is why everyone is tormenting you.

Even Skoda boy is taking the piss with his thinly veiled attempt at being courteous.

The question AGAIN is on the lines of this: where does the liability of damage on a motor vehicle transfer to a mechanic when they are doing work to your motor vehicle?

Perhaps seek the advice of someone in the legal profession.

Oh dear...

Sell the Falcon and buy a better car. If your weekend car is really a testarossa what are you doing driving a dunger like a BA for?

Don't get me wrong I drive a BA XR6T but if I had a redhead in the garage and worked as a lawyer I wouldn't be spitting chips over a broken oil cap.
