When someone is tailgating me and I jump on the brake and got rearended. Who's fault is that?

To enter a two lane (marked) road, you will need to give to the car in the lane closest to you I:e If the car in Lane 1 (closest to kerb) is in a position where, if you enter Lane 1 from adjoining street, would cause a collision, then you must Give Way.

That is something a prudent and reasonable person WOULDN'T do therefore it is Negligent.

The amount of negligence can then be determined by a Court if it is challenged.

It is only illegal (as of last week) to consume alcoholic beverages whilst driving even if you are under the prescribed limit for your class of license.

There is no prohibition on smoking, drinking, eating etc whilst driving EXCEPT if that activity causes you to have a collision and then it is Negligent.

The same goes for doing one's makeup, hair, getting dressed, smacking children, pulling bong's, injecting hammer, sniffing goey or whatever else that may cause you to not have complete control of the vehile whilst you're driving.

Of course other legislation may take precedence (Drug Misuse and Trafficking Act etc)

A driver on a road with 2 or more lines of traffic travelling in the same direction as the driver, and who is moving from one line of traffic (whether or not the line of traffic is ending) to another line of traffic , must give way to any vehicle travelling in the same direction as the driver in the line of traffic to which the driver is moving.

Sub rule 2 of Rule 148 of Australian Road Rules.

In the scenario you have given , both drivers technically have the right of way when changing from one lane to another. If both drivers indicate and both move into the centre lane at the same time, and are both at the same line/position on the road as each other when they make the manouevre, then both are guilty of Negligent Driving if they collide.

Reason being is that even though they are technically right in moving from the outside lane into the centre lane, when they are in the same position on the road and they indicate, it is negligent on their behalf to have a collision. One driver must give way, or one driver must accelerate/decelerate so that the other is either behind or in front.

During the lane changing manouvre it would HAVE to be apparent to the other driver that they are changing lanes because they can see the indicator flashing.

Over in some States in the US, it is illegal to have an opened bottle of liquor in the car!

If you are facing a green circle and wanting to turn right, you do NOT have to move beyong the Stop Line whilst you are waiting to Give Way to oncoming traffic.

What you have described is the correct way to make a right turn at lights: I:e wait behind the Stop Line until it is clear to turn right. The reason is that most people drive out into the intersection to Give Way to oncoming cars and the lights go from green to orange/red, and they make the turn and some cranker runs the orange/red light and causes a collision.

A limb (limb protrude) would include and the body, arm, leg, head or in the John Holmes category, an appendage (not being an arm, leg, head etc)

Resting an elbow on the window frame or holding onto the gutter (gutter grip) is technically a limb protrude but would unlikely be enforced. If the elbow itself was resting on the window frame that would be ine, but if your armpit is resting on the window frame that would be enforceable.

This also goes for sunroofs, especially if you stick your arms, head, legs etc out the roof (except if you're parked on the top of a hill at night watching the city lights)

Rule 126 ARR's

A driver must keep a sufficient distance behind a vehicle travelling in front of the driver so the driver can, if necessary, stop safely to avoid a collision with the vehicle.

That is a good reason for goosenecks and towballs that extend out past the bumper. That'll teach 'em !!
