My wife has had an operation on her foot and cannot put any weight on it for six weeks.

Wheelchairs and crutches aren't really practical round our place so I built her a sort of "scooter" out of some tubing, put a handle on it with a cushion to rest her knee on it and some castor wheels so she can move around the house.

She took it to the hospital when she had the op. and the surgeon says "where did you get that? so she tells him that my husband made it for me....

He asks if he can borrow it and takes it down to show the physio who seems quite impressed with it and asks if I'd be interested in making a couple more for the hospital.

I've since searched some sites for walking frames, equipment for the disabled and similar stuff and I can't really find anything like it.....

I've been told by a few others that I should patent it and start making them to sell to orthopedic specialists for hire to patients and such.

It's just that I wouldn't have the first idea on how to go about this?

Is there anyone on here who might be able to give me more info on how to do it? :buttrock:

before you do anything copyright the design

I reckon you have already said too much.

You need to speak to a Intellectual Property Lawyer.

Also you need to remember someone may have already come up with this idea and the design has already been patented.

The fist rule of patent is to not disclose the invention publically.

The second rule of patent is not to offer the invention for sale prior to filing a patent.

So, get the prototypes back under your control before digital images are posted over the internet...

Then, there is other form of IP control that you may consider other than patent. As noted above there is copyright then there is trademark, trade secret, registered design, plant breeders rights, etc

You need to think this through. Full patents are seriously expensive, say AU$50K for world wide coverage, and that does not include legal fees for preparation and prosecution.

A possible alternative that you may consider is the Innovation Patent. This is cheap, easy and simple and in some respects stronger than a full patent. The drawback is that is available only in Australia.

DO NOT put pic up anywhere.

DO NOT show to many people at this stage.

DO NOT offer anyone any units without some sort of legal doco - if you are serious about looking into making money from this.
