Who will the jusge believe? the Driver who is trying to dodge a fine by claiming he was doing "65-70" (which is still speeding) or the cop who used whatever resource to calculate his actual speed.

Also, by the time the wagon hit the lights to pull him over, he may have dropped to 65-70km/h before he looked at his speedo, but the cop could have had him at 80km/h 50m back.

No evidence from the driver, apparent evidence form the cop.

Cop wins. You pay a LOT more for the privlige of appearing in court, and you're still stuck with 3 points. I know what I'd be doing...

Its not what you know, its what you can prove in court

Judge cant just assume your guilty because a copper is apparantly more knowledgable.

Its more like person looking at speedo vs person looking at speedo, all basically irelavant.

Now if the copper had his recorder on and old mate said yea I was doing 80 bla bla, but has now decided to fight it, he should quit now.

Here is the variable. The driver has absolutely no idea what evidence the cop has. He never asked for proof. For all he knows, there could be full radar readings, video camera, voice recording admitting he was speeding etc etc.

The risk of taking the cop to court and just hoping he has no evidence is waaay too high. And he is still going to receive a fine because he was still over 60. I'd listen to Henz. Quit now.

They aren't required by law to show you the speedo reading.

Unless your mate was legitimately doing less than the quoted speed, I wouldn't bother wasting the time to fight it. As the other guys have said, they have cameras and recordings throughout their car. If he takes it to court, he needs to go in and basically admit that he's an idiot and has since learnt his lesson, and has taken steps to feed his need for speed legally.

Just before the hearing your mate will get all the police evidence he is required to receive, that's when the law states he is entitiled to get it. It is not uncommon practice to send a ticket in the mail police have been using this method for many many years. Statute of limitations for simple driving matters is 6 months but if it goes over 1-2 months it is more likely you will receive a summons than a ticket or nothing at all.

he got the fine in the mail. $239 and 3 demerit points. He remembers the copper putting words into his mouth, cop basically came up and said "you were doing 80km's in a 60km zone, any reason for speeding tonight?" .. "umm oh, im not sure" .. "just don't know the speed limits on that road right?" .. "umm yeh I guess, sorry" - I guess that's considered admission?

so I guess I will tell him next time to just plead ignorance and innocence and then contest it. Also, if he did try to contest it, wouldn't every copper in the area be after that particular car with that license plate? I guess they would take it pretty personally that you were trying to make a liar out of them?

Everything your mate said would be recorded, and that's what it would be based on. I have a mate who is a copper, was doing 110 in a 60 in the middle of bumf*ck Idaho, copper cme up behind us with no radar, and knowing what to say saved me a huge fine and long period without a licence, I received a broken collarbone though.

Again, it all cmes down to what you say. Ask for proof straight away and deny deny deny. No proof equals no charge.

Ps u recommend not speeding at all.

I don't think they will lose sleep over it. Unless he has a history with drugs or similar he wouldn't even be on the radar.

As for saying nothing, that can be just as bad and infuriating. People should just man up and take the consequences for their actions. Sooks are the sort of people that do hit runs.
