Importantly the legislation prohibits inducing or encouraging a person to commit criminal activity or corrupt conduct that the person could not reasonably be expected to engage in unless so induced or encouraged. It also prohibits conduct likely to seriously endanger the health and safety of any person, or cause serious damage to property (s. 7).

I think these are the most pertinent points when referring to street racing. This was more about setting up a sting operation than entrapment, but it is valid because if an officer entices a person to street race, and an accident invloving pedestrians, other vehicles, or property occurs, the person in question may not have necessarily taken that action if he wasn't provoked to do so.

Just because someones revs there engine at you, is not entrapment, you choose to drag race them. If they leaned out the window and engaged in conversation that invited you to drag race you may have a chance in court, but in the end of the day, you know drag racing on the street is illegal and you willingly entered into it.

The only out I could see, is if the policeman actually partook in an illegal activity such as street drag racing then booked you for your part.

Big disscussion in QLD at the moment that police are recording conversations, civil libities people are up in arms and the majority of radio callers are making all kinds off wild accusations as well.

The fact of the matter is that a conversation can be recorded as long as one party of the people conversing is aware that the conversation is being recorded. Ie you and policeman, as long as the policeman is aware that the conversatuion is being recorded then it is legal. If it it were a third party then the recording is inadmissable.

POLICE have been doing this for years, helps alot when writing out their police notebooks. Police notebooks carry alot of weight in court and shoeld generally contain direct speech in them, made during the conversation, or as soon as practical after, and are known as contemperanious notes.

Thanks for the info Tom, could be interesting if a cop did try to egg you on for a race.

As for the recording of a conversation, I always record anytime I am pulled over. The cops do not like it, but it is my right and they are usually recording me as well.

I have also found the police will have a big attitude ajustment when they are on candid camera. I love the features of a modern mobile phone.

Guys, after talking to some cops when I used to work at a Kebab shop and cafe I have learnt alot about this kind of stuff. It will be very difficult to prove that an officer had engaged in the organisation of an illegal street race. Just like an undercover cops organising a drug bust, they do what they have to do to get the sting set.

Street racing is illegal everybody know this. Unless the undercover tailgated you and ran up against you organised a back street form you to race you have no chance. Don't forget cop cars are fitted with cameras and mics soall that is called in court.

They always told me that when you are pulled over the majority of cops will go through a serious of questions (an attitute test) this is where they decide whether you commited the act with due knowledge and if there is any remorse. You have everyright to take down the officers details in the matter and record the conversion but if you have committed an act against the law then you are in the wrong. Whether you pass the attitute test or not determines if you get a fine. Some officer don't care and will book you regardless these are the revenue raisers.

I would hate for people to get a false sense of security and try and get a cop for organising a ran then get stung.

up here in Cairns we've had a marked red F6 Phoon getting around for a year or so now. before that it was a red Expensive Daewoo monaro.

Around Newcastle this week 4x F6 Highway Patrol cars have hit the streets.

The 4 I've seen are unmarked in Breeze,Bionic, Orange, & a yellow-gold colour.

I'm sure they are in other areas so watch out.
