there is no mention of retuning over and over like we have been doing.

I believe they could argue that that this feature was not it's main function but just a by product of what was possible

CAPA : Ford Flash Tuner

Has any one got an advert showing that retuning the box was it's main function?

"CAPA Flash Tuner is the complete stealth programming system to unlock the hidden power potential of your BA-BF Falcon or Territory"

Seeing as PROGRAMMING SYSTEM is in the first line of their promotion/advertising for the device I would say that programming ECU parameters was it's main and ONLY function. Your only rebuttal may revolve around the programs (aka tunes) being "preset" or "single use" however this falls under misleading conduct and marketing deceit as if they were preset or single use it would take away from the products "programability".

I have also now lodged a complaint through the ACCC aswell for SCT and CAPA's breach of the trade practices act.

I have also contacted a friend high up in consumer affairs who also said he will be looking into it.

They are going to look into it now. I'm not sure what will happen next but if they want any more information they will contact me again.

Anybody else feel like lodging one please do at this link: Create New Complaint

It's pretty simple and easy. I did explain this is a nation wide issue so the more the merrier.

im not sure if nizpro wants to get in on this but would it be wort posting this link on the petition site?

Am I the only person who has an Xcal 1, was only a week or so off the cutoff date to touch up my tunes and am fairly OK with the deal of having to update to Xcal 3?

I am amazed at the way so many people have their noses out of joint; I'm not saying I'd want to if I had a choice, but in the same merit I wish I didn't have to pay money to update half the stuff in my house as time goes by.

I suggest you all put your cars back to stock and get chummy with your local ford dealerships and just update to the new model every 2yrs lol

mate I would do that if ford after 2years locked on the brakes on my car or in there sales pitch advised me after 2 years it would be a garden feature!!!!

as for having to pay $500 for a new box when the old box was fine????

SORRY I WOULD RATHER SPEND THAT MONEY ON MORE MODS OR SNIPER/DREAM SCIENCE ETC TUNE.

I would understand if I sold my ba and bought a fg .no worrys I would update but not for somethink that was fine before somebody decided to screw it up becouse there codes could be cracked/security compromised!!!

daniel!!!!

do you see microsoft switching of windows or vista becouse people have copy/forged there programs?

no .

IF SCT HAVE A COURT CASE WITH CAPA WHY DIDNT SCT WAIT UNTIL AFTER THE COURT CASE TO INFORM US OF THE CHANGES!!!!

also I recomend you go back to page 1 read the capa letter and under stand how sct first screwed capa

I am concerned at where all this is heading..... I hope that SCT don't pull the pin on the Australian market because of what is happening at the moment. I'm not sure how big the market is for them here. If not that big why bother? As mick (ratter) has said this is his chosen product for tuning and many other tuners because of the options it has on it. I hope this doesn't turn out pear shaped.

Once again this could have been handled a lot better way than it has done. Both SCT and herrod need to sort this out pronto. Not that it probably will. It could damage many businesses in the tuning game if things get real ugly. I hope it doesn't come to this.

I hope for those that have XCAL 1's get it sorted, I hope the same doesn't happen with XCAL 2. Most importantly SCT get it right with the current product they are selling to support current australian vehicles like the ZF Box.

My 2 cents...

I can't remember where but I have heard that the Xcal2 is headed much the same way. Maybe SCT could chime in and clear that up for you. You are safe for the moment, but so was Xcal1 until last week.

Our market here is totally different to the US. There's a a hell of a lot less of us and we tend to hold on to things longer. This is in part because they cost more of our wage and we also look after things. Take my car in my sig, bought it new six and a half years ago, love it more today than when it was new. Ford haven't made a sale off me since I bought it and neither have SCT since I bought my Xcal1.

In the US a six and a half year old car is considered a clunker and ready for the scrap heap. Buy another, they are cheap.

Hell, X3's are cheap in the US. I could get one delivered to my door from the US for under AU$440.

The problem then is the FirmWare. We need to run the FW for AU cars and the US Ebay ones come with US FW of course.

I wonder how the FW is flashed on these things? With other stuff like my motherboard, router, phone, media player the manufacturer gives access to all the FW from around the world so I can try different ones from other regions.

FW is free.

Could SCT provide me with the AU FW so I could flash an X3 for use here? Maybe another question they could answer if they felt like actually saying something.

GR8XR6, I've also heard the X2 box also doesn't support ZF, only the X3 does, but I could be wrong about that as well as SCT turning off the X2 later in the year. Time will tell what happens about that and if ZF tuning ever comes out, not that I'm holding my breath as I have a manual.

Nathen, I have read (on this forum and others) the whole damn load.. in this thread that's gone so far off topic here 'n there its laughable; nowhere did I mention Microsoft in an attempt to give direct comparison so I don't see why you dragged them into it.

Everyone here has the opportunity to spend their "$500" as you put it, on anything they like whether it be another Xcal or not, your choice.

Everyone here has the opportunity to hold out and see what happens with the uproar and court case/s in the hope of a major backflip, again it is your choice.

As a personal opinion...

From what's happening with the obvious companies in question and the market in general; I'd say there's notable change in the wind (ZF tuning seems to be the most common guess around, time will tell) and I am far too busy being excited about the possibilities of this than to be pissed off and stressed out on the negatives of this situation, as it stands anyhow.

I'm happy seeing some good change in the arena and hopfully a new level playing ground for the market we, the genuine paying customers 'invest' in. I think the Xcal 1 was a crude design that was flawed from day 1, maybe they should of done more before releasing it and maybe it shouldn't of been released with these flaws at all as some have said with the worry of possible illegal use - BUT, I made my own decision to buy, tune and to use it for years.

Oh, and lighten up on the poor exclamation marks :P lol

Now, how the whole situation came about isn't ideal for a group of us, this is obvious, but in no way was it unforeseen as it's been in discussions for quite some time.

It has? Where/how/when? :icon_ford:

That's the point that's got everyone so pissed off, there has been no prior announcement just an email from the distributor saying "oh by the way, last night we disabled the Xcal 1"

The other issue of course is they aren't allowed to do this, it's unlawful. They can announce no further support and updates for the Xcal1 but disabling it's primary function, being able to program it an infinite number of times, is a no no.

I think Gene is right and Fair Trading will take an interest in this.

Australian Consumer law is very powerful when actioned and has caused companies like Microsoft to change their licensing terms and make large companies pay a lot of money to make things right. The problme is they will not do anything unless they get enough people complaining.

I have watched this issue unfold for over a year, I seem to remember SCT threaten the same thing when CAPA lost their distribution rights. They were going to give 90 days for the XCAL1 and 6 months for the XCAL2. It was only when a massive backlash occured they backed down, so the writing has been on the wall for some time in relation to the underhanded dealings that SCT are capable of.

SCT can do whatever they want, it will be up to Herrod who are the current distributor and YOUR tuner to carry the wraith of DFT as they are responsible in Oz for the SCT products.

CAPA and SCT will play no part in what happens, I just hope Herrods are ready for this.
