Just Got Epa'd

I got done for excessive noise(no wheel spin, the cop admitted it) when I had an au xr6 with standard exhaust. Went and got the car db test and a report that said the car was within legal limits. Wrote them a nice letter with the report and the fine was waived.

Don't know if that helps....

Glad to see that the wonderful law enforcement oriffecers are out at that time of night getting rid of all the physco's glassing people.

Before the wrong authority is blamed for your issue once again, you were higly likely sighted by EPA inspectors or VIC roads, who do not hold any power to stop and inspect your vehicle while it is being driven. The letter you have is intentionally misleading so as to not attract attention.

So what would be the consequences of ignoring this letter Iconic?

Is this a case of him being guilty until he forks out the money to prove his innocence?

I feel that this is wrong personally.

If VicRoads or the EPA have reported a possible issue, then shouldn't the onus be on them to provide the service to test the vehicle free of charge ( and then fine accordingly if the vehicle is illegal)?

Is there another avenue that can be taken?

Regardless Victoria is definately the "police" state isn't it. Another reason to keep away from the sh*thole!

I dont see where he has been found guilty of anything. Arnt we all required to show our cars are roadworty each year and pay a fee for that??

Im sure they have the ability to provide the service but its up to the respective States to choose what they charge for and the public to protest if they dont like it. Not enough protesting and alternate voting takes place in VIC in my opinon.

On that note...

However I also think it is extremely wrong that your sent a notice advising that you need to pay for additional testing of something at your own expense where there is no justification that there is anything wrong. 35$ or whatever, or not!

I would call Vic Roads, and the EPA and request for details on the manner and basis this letter has been sent, and on what grounds...

No yearly roadworthy is required in Vic as far as I know. Only upon sale of a vehicle/transfer of rego of a vehicle into a different name.

The fact that he has been ordered to do this ( and via the post and at his expense) seems above board to you considering the above?

Not in VIC... You just pay ya rego in time and your sweet...

I got a Defect a few weeks ago, no fine, just had to go to VIC roads for them to asses it. All was good and I was on my way, just time wasted. In this case I believe im actually paying for the Exhaust Shop's time, to test my car, not a goverment building. According to the letter I wasnt doing anything 'bad' on the road, just that my exhaust MIGHT be faulty or too loud. I say I shouldnt pay until im found guilty, not 'oh I reckon his exhaust is too loud, he should pay to get it tested'

I.B. if u knew where I was you'd know that it must have been cops... Maybe being in that location I was asking for it.. Meh.
