"I wanna see how high I can get it officer" times 4000 ppl. Some other legal minefield would also exist for breath testing passengers who then drove somewhere later in the night, crashed and blamed the cops for passing earlier on.So not stupid, just right and lawfull im my view.I.B.I understand what you are saying, but my sister was genuinly concerned, there is no other way to know for sure if your over the limit. She didnt have too much to drink but how can you be sure you not .053? 'Just a little bit over officer' Those hand held bretho devices I doubt they will hold up anywhere worth mentioning, and the machine that I've seen at Crown is a POS, that just takes your money and how do you know if its correct?All im trying to say is, maybe there should be a means for people to get an accurate BAC reading, and then make up there own mind if they should drive or not.. You are not expected to have a p!iss up and then drive home while at 0.049999999 and then calculate all of your drinks, factor in your weight and if you ate throughout the night and then try and explain this 3 months later to some old bloke at court. Why play this silly game of chance in the first place. Dont waste everyones time hunting around for a breath test device. The right thing to do is get a Taxi and not drive if your that unsure. I'm pretty sure that if it's open to the public, then public road rules apply.Likewise, an unlicenced driver can't drive a car in an open carpark. They ruled even further by stating that car parks, even closed to the public permanently or after hours but at some time had been open to the public still fits this public road criteria. Even car parks that are not even open yet or ever been open to the general public, such as a private car park to an office block, if they are so used by the public even against the wishes of the car park owner also fall into this argument.This came from a pedestrian that was hit by a car in a private car park that had gates and was sealed off to the general public. The pedestrian used the car park as a short cut to get to a service station but the car park only prevented vehicle access and it was so ruled to be a road related area or the equivelant to a public roadway.I.B.
