Loss Of License

Hi Guys,

Well got the lovely letter in the mail from Qld transport saying that I've accumulated 12 demerit points in 3 years. Now the first points that I got were back in 2006 when I was still on my P's. As far as I was aware you get those points back after a year. Since the loss of those points I've lost another 9 points this year. So I should really still have 3 points left from when I lost the points on my P's.

I rang Qld transport up and the lady I spoke to gave me this explanation. "Yes I do have the 3 points back but because I have lost 12 points in the space of 3 years I still loose my license." So basically I have 3 points to my name but the loss of license still stands because I have lost 12 points within 3 years.

Does this sound right to everyone? I'm just a bit baffled as to how I can have 3 points still left on my license but still loose my license. Any info you may be able to shed on the subject is much appreciated.

In VIC you get your points back after 3 years not one.

In Qld when you are on your P's if you loose points you get them back within a year. Once you are on your opens if you loose points you get them back after 3.

She even said to me I know it sounds stupid but its just the way it is.

that's crap.. is there anyway to take it to court or sumthing?

I have no idea, I'm hoping someone on here may have come across this before and may have some more information for me.

You can take anything and everything to court and everyone knows that, but its one thing to come on here and and write such statements without offering and real advice.

And your drama sounds about right, though each state varies in how they attribute demerit points and carry over from provisional licence periods.

Note you accumualte points and in fact dont lose points as most believe.

In NSW it's 3 years regardless of license, but if QLD rules are different and say demerit points last for one year only on your P's then you should take it to court. Those 3 demerit points from your P's should only last for a year and should not be taken into consideration.

Court costs around here are only about $60 or something so you haven't got much to loose.

Another way to look at it is, you got 3 points to last you 3 years, do you really think you will not be fined in the next 3 years lol, so basically you will loose it anyway.

If I was you I would be filling out that court hearing form, you should have a good chance of winning.

I dont know the law but

when you get your opens you get a full 12 points.... now unless you lose all 12 of that particular licence you should not lose it.

I would take it to court and have a shot.... you got nothing to lose except a little time and a little money.... at least this way you will find out for sure......

if you dont take it to court, you will always wonder what if!!
