that's what im worried about, cause ive been there longer than 7 years im entitled to long service leave, and also have nearly 40 days of annual leave accrued too......

If they are nice about it I'd give them a bit extra, maybe even meet halfway and do four and a half weeks? :beerchug:

Firstly Congrats on the new GIG MATE!!!

As for notice period, you will need to check you contract, and depending on that aware you fall under (if any) it may vary also.

Worth giving IR a call and just double checking as it may depend on your industry.

If you have not always been full time, this may have some effect on this also.

Assuming you get along well with your boss (considering you have been there for 8 yrs), and the fact they want to hang on to you till the stars date, indicates they do like you (or maybe want to make your life as hard as possible, however most companies now days will say see ya if they dont the min you give your notice)...

Having worked in recruitment for 12 months last year, as well as running my own business for some time, you will find it really depends on what the company and role fall under. So again give IR a quick call and just double check with them...

You'll have to look at your contract or deed of employment, but it's generally 4 weeks notice,

tell him 4 weeks, sorry. What's he going to do? Sack you?

As dags mentioned also, if he breaches his contract then he may lose all his entitlements... Or they may make his life harder to get any monies he is entitled to...

4 weeks over 12 months of work is the 'normal' rule of thumb, however again NOT ALWAYS THE CASE!

He can't lose all his entitlements, the worse they can do is deduct the unworked notice period out of any unpaid leave etc.

He would get the holidays and prorata LSL no matter what.

In theory he could take leave and never return as he has 40 days.

Best to speak with the boss and come to an arrangement as it is never good to leave a job on bad terms.

cool banana's thanks for all the advice guys!

I have contacted the government Workplace helpline, and also my current employer's inhouse accountant dude, and they have all said I dont need to give any more than 4 weeks notice. And considering my new job does involve moving interstate, im hoping my current boss will be a little understanding and accept 4 weeks. Im seeing him on Tuesday to sign all the paperwork.

General rule of thumb , no more than 4 weeks notice required unless it explicity differs in a contract. Not sure about ACT law but you are not entitled to long service after 7 years. From memory it is generally 15 except SA which is 10. You are however entitled to pro rata

which for 7 years would be 6 weeks pay. This plus your annual leave entitlements should be paid in full.Be sure that you are taxed at the correct rate.
