Also Gillard was saying that the inspections must be be done outside of work hours (lunch, smoko or the like). I guess if it is carried out as it should be like if there were blatant breaches of underpaying workers etc. it might not be to bad but I do worry that heavy handed union involvement might creep in. I'm not an apologist for the unions or Labor party as I have had run ins with unions previously, Live and have a business in sydney and when I was asked to carry out a job in Melbourne had a union try to stop me from working on site so legal action followed and to the union's disgust I ended up working there. Not against anybody wanting to join a union, however I wont be bullied by some arrogant loudmouth union official trying to threaten me off site because I'm not a union member. Also they can do these inspection when they wish. My place of buisness is also my place of residence, so they can walk into my house whenever they want. Not even the police have this power, they need just cause. Here lies the rub.I'm certain unions had /have thier place and I have no objection to them either, except when people are forced to join (as they forced me to, when I went to Uni) and when they are given powers that go beyond those of normal citizens. Compulsary union membership at Uni what bollocks...Thier reason for it being compusary? Well if it wasn't nobody would join! I paid my fees for four years, all of which went to the likes of Simon Corbell who used MY money to launch HIS political career in the Labor party. I would like to say that this whole thing is just un-Australian, but I fear I may be wrong. Bludging and winging that others have more than you do while being told what, when, how and where we can conduct our lives seems to be what the majority of the populace wants, it's a democracy so we've gotten what we voted for, fair enough, I don't have to like it though. It states that unless the employee is a member of the permit holders organization, I.e. union and they do not have permission from them they can not access their individual records. However in a later clause in regards to non union members it states that the permit holder needs to apply to the F.W.A. (Fair Work Australia ) which is "supposed" to be the independant umpire and replaces industrial relations commission, workplace authority, fair pay commission etc. and show good reason why they want to investigate any suspect contravention and also 24 hrs notice is required with entry only permitted during working hours. I did note that the persons entering the worksite must comply with the particular O.H.& S rules on the site so I would make them sit through 4 hours of safety videos and inductance tests and insist on the usual minimum of NSW White card (formerly green card) which is a days course. Sixfan, if your office is at your residential address and it is mainly used for residential purposes they CAN NOT enter at all (section 493) so you should be okay, although unions being unions they might try but hopefully the $33,000.00 fines for abusing privacy laws might slow them down a bit.
