Think of it as an overdrive which is engaged at light throttle applications to drop engine RPM and save you fuel. 3rd gear lock out is not needed and a pain in the arse if you ask me. Only time I ever notice it is when the car is in manual or performance mode as any other time the car will sit in 4th gear cruising at any speed. Like you care about fuel economy if the car is in manual or performance mode. I have seen this problem before, you will find it is the thing connected to the gear shifter on the drivers side.
