I'm going to write in cos copper said

"from where we were it looked like you went through the red"

I maintained that I crossed into the intersection on the yellow, and this is where it gets weird.

copper said, "same fine for yellow or red, I'm giving you one for red"

I questioned the statement about the yellow, and he said "if safe to stop on yellow, you must stop"

Mrs BCB said that maybe copper was upset cos when he asked me if I had been drinking I said "I dunno, cant remember"

cos we had lunch at a restaurant and couldn't remember if I had had a drink, cos left brain in QLD    

Anyway, it can't hurt to write in, who knows, they might be nice for a change.

You also shouldnt get any demerit points taken for it either as it was in another state. 

 

Easy to contest though as you can say you didnt know thr area and got confused etc etc. Play the whole out of state game, if you have decent record it wont get a 2nd look

He could actually end up with a warrant for arrest if he doesnt pay it. and yes he will lose his license if not paid

Cris is right. 

Check the ticket for fark ups. If there isn't any plead a section 10. If good record you're off with just the fine.

If you want to challenge this, I'd start by figuring out exactly what the cop would have seen from their viewpoint so you can trip them up under oath.

 

find out if they had a dashcam/etc. he shouldn't have fined you as to me it sounds like there is reasonable doubt as to whether an offense was committed. (I.e he wasn't sure if you ran a red or a yellow, so he can't be sure if you actually proceeded through a green).

 

depends how much time you've got and what really happened.

Were you over the white line when the light was red.  If yes , just pay it.

Not true. States are still not linked and each state needs a court subpoena to pull records from each state

 

Only linked for interstate truck licences hence why they try to push you to get a new licence in each state move to.

If the light turns red while u are in the intersection?  your farked.

Just pay it and move on.

U change llicences due to address and mailing of fines etc.

U dont change address when u move and u get a fine sent via mail u wont know and your lic will be suspended after 28days.

remember me complaining a few months back about receiving fines from the northern territory for a car I sold to a backpacker?

 

I got like 5 fines. after contacting them I found that the records are definitely shared between states but it is literally a few months old. I.e they had to contact WA directly to confirm I'd disposed of the car.

 

and im not sure about the light turning red AFTER you've entered intersection - I dont know how the other states consider this, but that only show that you had time to stop on the yellow.
