Well looks like I'll be going to court over a parking fine and I'm fuming. Been onto them since I got it asking for some sort of proof because I know for a fact that I could not of been parked there for two hours. After months of not returning my calls I get a letter in the mail on the last day to pay it saying the officer recorded my car at this time and this time at that's it. I know they are full of sh*t but how am I going to tell the judge that.

Has anyone had similar drama's but got out of it? I'm thinking stat dec's from my work colleagues?

Any help would be greatly appreciated.

Cheers

stat dec's are a must, but what it comes down to is his word against yours unless you can prove it ie: apointment times (if you where going to one) shop receipts (they will have the time on them), if you have one from nowhere near where you where parked in that 2 hour period before or a stat dec from someone saying you where with them in the time you got pinched or even before then and then factor in traveling time (google maps) saying that you couldn't have gotten there in that time ect. good luck mate

They usually take a photo of your car when they issue you with a ticket, I paid over $500 in tickets in 2007 and all my tickets were over a 3 Month period, very hard to win with these c*%$s, just pay the fine and be done with it

Take plenty of lube, it will not help you win, but it will lessen the pain when they bend you over.

everyone else is really negative. Have your say and dispute what has been recorded. even in VIC I still believe they have to prove the offence to the standard of beyond reasonable doubt. Put them to work as there the ones that have to prove you actually did the wrong thing.

Im wondering if VIC is like NSW now, whereby the revenue from parking fines is now handed back to the local councils as a huge source of revenue.

Have your say as your entitled to it. Doesnt matter if the charge is murder or a trivial parking ticket we all get to have our say if we choose too.

Thanks fella's, they already told be they haven't got any photo's or anything so it's going to be my word against theres. If I win I might looking at going after them for more I.e damages (wasting my time). Last time I contested a train ticket they bluffed me right to the front door of the court room and then called it off cause they new I was right, but I had to take a full day off work so I lost money anyway. There Scum.

Damages, or more commonly known in AUS as costs awarded is usually only ever granted because of two things, 1. Gross negligence on the part of the prosecution as in failure to investigate the matter to a set standard, or 2. malicious prosecution.

Good luck.
