Cadburys have trademarked the colour purple.

Cadbury tried in march of 2005 to trademark the colour purple, and failed. Google it if you like. I did mention we have quite a few trademarks in the family which we did ourselves (no solicitor), I know a bit about them.

you cannot trademark any word or slogan that is generic, forinstance, 'Gday Mate' is generic, so it cannot be trademarked.

and for the guy going on about BMW and Merc, unless the badge on the car, actually says 'BMW' or Mercedies Benz, there not breaking any laws, and the lawsuit will be simply for publicity purposes. They havnt got a hope in the court room.

I'll say it again, I'd bet 15 years ago most of the guys on this forum used the words 'Jap Crap' quite often, you dont hear that saying any more.

Seriously dude you are out of your depth. Try and open a burger store called MacDonalds and see how far you get....it's different, it's got an extra letter in it, surely they can't stop that!

companies can patent a colour.. but it has to be that exact shade down to the 1/255 of the red,yellow, blue scale. One bit different & it's not "the same colour"

You cannot just reverse engineer a car, computer or whatever and then remake it under another name. It is called intelectual property theft and is a serious CRIMINAL offence.

You can register a colour, just try to buy a can of Malbro Red or Coke Red. These are trade marked colours. As for generic statements, go and label a software package "Wesley Windows", I bet Micro$oft have you in court with a cease and disist order before you produce the first copy.

While you can do some things, it will only be a matter of time until the Patent,Trademark or registered owner takes offence and sues you. Being in the IT industry, we see IP theft cases all the time. People leave one job, starts a new company and the origional company finds their code in the new companies software. They usually win.

I think you are being a bit general in your claims. How would you feel if I started makign whatever you have patents for, if I only called them a different name ?
