The way I understand the new laws is that its called 'excessive something' so you cant even take off hard at the lights.. One of my mates got done for it. But add the other car as in your situation and that's in another category...'illegal street racing' which will incur a more harsher penalty... I cant remember what my mate copped I think a suspended licence. But that's in VIC...

Im not 100% sure BTW cause these laws are different between the states and can be interpreted differently.... But good luck anyway.... to me also seems sus the way its being handled...

I remember an letter to the editor in wheels mag 2yr ago a chap in his fifties driving a Monaro got done in Brisbane for excessive acceleration from lights to 60km then he backed off but still had to cop the fine.

I'd like to know how they come to the conclusion of whats excessive acceleration a T of the lights against a slow cars in lanes next to only doing 1/4 throttle and you can pull an easy 2-3 car lengths and you could be booked

If it weren't for the other car, it could be seen from a possible safety point of view that getting ahead of the traffic (without exceeding the limit, breaking traction, etc.) gives you the added buffer that most drivers refuse to let you have normally.

Aside from the obvious ability to worm their way to the front, there's a reason motorcycle riders do it and that's the reason.

going thru sydney yesterday afternoon it was raining, pulled up at the lights guy next to me was clearly looking for a drag, he got the jump on me, I nailed it got too much wheelspin back stepped out short shifted into second little bit of wheelspin but tracked up and I passed him yahoo, it was short lived 20 minutes latter I was pinned in fourth and he flew past me, I was lucky there wasn,t any police around or we could have had our vehicles impounded. by the way I was in diesel hilux towing car trailer he was in kenworth b double. WHATS THE DIFFERENCE NOT XR6 TURBO BUT WE WERE RACING. would the antihoon laws be applied to us

I havent found the actual legislation yet, but will keep looking.

A mate and I were driving in his gemini, not a real magnet, but gets a look in from cops every now and again, and this tool is riding on our arse, you could not see his plates he was that close. So it comes to dual carrige and he hammers past, we stop side by side at the lights and he burns off and we pull in behind (dual ends) the next dual comes up and we nail past him (safely) and slow back down to the speed limit, hes back on our arse again, so we keep going on our way ignoring him, and he starts flashing his head lights, I tell my mate to just lose him but he decides to pull over. Then we see this cock get out of his beaten up camry is wearing all blue police uniform (we live near a mounted police training centre) and he reads the riot act to my mate and takes his details, records everything on his little tape thing, hes saying stuff like dangerous driving, speeding etc. He tells my mate that in two weeks he will hear from a judge.

That was 5 years ago. nothing came of it, I put it down to some tool who thought he was something else heading out to muck out the stables who got pissed because we were playing with him and making him late to work.

First I would want to know: do they have proof you were speeding?

If not then just say I was doing a safe speed, unable to constantly look at the speedo but I imagine id be doin 70, 75. No proof? No chance.

(This is were a lawyer would help)

The fact is on a quite road, in safe cars we are over regulated. There is nothing you can do with out breaking a law of some kind. The government and laws are OURS. So how do we get so controoled by nitpicking government. I should note that I would never condone wrekles driving especialy when there are innocent people around. This little spurt for 30m's doesnt sound to dangerous IMHO

At the end of the day you just need to cast doubt on the whole situation. Say the cop was distracting or something. I dare say you will be fine

Yes there are bad apples, but the majority are fine people that are there to help when you need it.

I think this thread has run it's course until he gets a court summons, or as I suspect, nothing because they were trying to scare him.

Well tonight my mate got his court summons (the detectives personally delivered it to him) anyway I went over to read it and the bullsh*t they have put down.. makes me really angry/worried..

for instance they have put down they we were doing way over 70 before we hit the lights (I had cruise control on and I was doing 70) and after we did the whole race to the single zone it says we turned right (we turned left) and punched it again, and we both didnt..

I admit the fast acceleration off the lights was wrong and COULD have been dangerous, but when we hit the single I was a good 10 metres infront.

So I'm gonna loose my lisence over possibilites that it might have been dangerous?

I havent got my summons yet, but now im really worried, my mate is going to be trailed as a child and im gonna be as an adult, I had passengers to..

The D's said to my mate that the LEAST that's gonna happen is that we are going to loose our lisence for 3 months, wtf is the worst??? im not gonna go to jail am I???

Anyway the summons said that the court hearing is may 16th so I can freely drive untill then..

OFFTOPIC.. Any chance the W.A cruise boys can make a cruise before that date? :stirthepot:

Have you read any of my advice about writing everything down ?

Get statements from the people in your car about the events that transpired. Make sure you tell them not to BS or talk to eachother.

If you are being sumonsed to court, then it is criminal charges and I STRONGLY suggest you get a lawyer or at least some legal advise as this will affect your driving and also personal record.

There is also a strong possibility of getting off these charges as tghey are detectives, not highway patrol officers. They are also driving a non highway car, so it is unlikely they have a calibrated speedo. This means they cannot book you for speeding.

It will come down to your word vs the cops. If you have supporting styatements from your passengers, they you should get off.

I am not a lawyer, but understand how the system works, so make sure you are prepared. Get photos of the intersection, details on your car, and most of all statements from the passengers and yourself.

Remember the HOON laws are a matter of opinion. There is not such thing as a Hoon, this is just a "media/politician" word used to describe many types of drivers.

My summons never came either. My wheels spun for 2 seconds was the offence.

They go overboard. Is this a free country or what?
