We must take the car and give the ticket, if we are found out not to have one of the above mentioned then we will get our ass kicked. Obviously you disagree with some of the laws within NSW but each to their own. Somebody has to do the job and if your unlucky enough to get caught then you must wear the punishment.mate, these hooning laws give the police the power of descresion like never before. theyve basically given the entire punishment process bypassing the courts, to the officer at the immediate instant.... Just like the "move on" powers you acquired back in 2000 for the olympics.YOU have the power to decide whether or not the driver of vechicle is "testing the vehicles acceleration or handling" (just some of the loose wording in the legislation) and therefore "hooning", OR, perhaps he was just driving a half decent performance car...They made it easier for police to arrest people without a just cause by loosly worded legislation in order to achieve a goal that couldnt otherwise be achieved LEGALALLY. for the most part, because HOONING is hard to define and therefore enforce... this type of legislation would be impossible in a truely free country with sound civil and constitutional rights that sadly we lack... ALL of our civil rights have been erroded in the past 10 years.The Hoon laws are total BS and if any cop took my car from me for 3 months, I would sue him personally, the police force and the state govenrment.Any law that allows someone's car to be taken away for a loosly worded action, yet has no provision for someone who is caust drunk driving for the 20th time, is VERY wrong and should be challenged.If they think they could get my $70k+ car without a fight, the would be kidding themselves.Due to all these new laws I video any interaction with the police so I have evidence of what really transpired. The police do not like being videoed, but that is there bad luck, I am within my rights to do so, so I do.I also suggest to everyone to do the same, or at least record any conversation. Under Australian law you do not have to tell the other person that they are being recorded, only one party needs to know. Mobile phones can record video and audio, just remember to use it.I find the police very different to deal with when they know they are being recorded. I remember a while back on 60 mins or similar, a cop mounted a tiny camera to his shoulder and videoed everything he did for about 6 weeks or so... I thought to myself, why dont ALL police have this equipment as standard like a radio or a gun??? Then nothing would be "open for interpretation" or here say when matters come to court... just cold hard evidence.... then I thought about it some more... the cops dont want that... which is why it doesnt exist...
