Now, the thing is I regularly drive that stretch of road and am always on cruise control of 110 and just can't fathom how I could have been doing over 125 km/h.Now, $100 is $100 and if I was speeding so be it and I would normally take it on the chin and just pay it, but I don't reckon this is a fair cop.Anyone had any similar experiences and has challenged it? I guess it's just my word against technology and I suspect I wouldn't win.Yours dejectedly,Lightning.... He used to work for ford and refused to drive anything but the best. ANyway on a double demerit point weekend he was clocked at 160 in a 110 zone driving a TE or TS50. He managed to wiggle his way out of it by default. I think the photo was slightly dodgy........make sure you check the photo to ensure you are the only one in the pic. A couple of problems with your suggestions, the alleged offence took place on the 5th of Feb, over a month ago. Surely they won't accept a request to test a portable piece of equipment from a month ago?Secondly, I don't recall seeing the device on that day (I quite regularly pass them, I am on CC at 110 km/h, they don't flash, and I think 'sweet another fine avoided'). The location is damned vague "Old Coast Road, Preston Beach, Near Preston Beach Road".Bugga it. Presumed guilty...Lightning.... Thanks, I think I will opt (for the first time) to view the photo in this case.It's not the point or the $100 really, it's the goddam cliched principle of it. I really can't think of any reason that I would have been doing over 125.Lightning.... Lifetime Members 7,935 Member For: 21y 2m 25d Gender: Male Location: Sydney Posted 14/03/06 11:28 AM Share Posted 14/03/06 11:28 AM I do not know the WA regs, but I would do the following:Get the photo and make sure it is your car and that it is the only car in the pic.Elect to take it to court, no matter what is in the picRequest: Service history and logbook of the actual Multinova, the details and certification of the operator of the device, the exact location of the device, the method and time of calibration of the device on the day of the offence.If you ask for EVERYTHING in writing, it is very likely that the police/government will not be able to get you everything before your court date. Turn up to the court and tell the Magistrate that you pleade not guilty, and that you have not received evidence from the police to enable you to mount a propper defence. Make a complaint that they have had enough time to provide the info and he/she may dismiss the case.It is worth a try, as you should get off and it is interesting to see how our courts work. Now, the odds are that if an officer had pulled you over and written you a fine you would tend to recall the event even more than a month later.At least the operators are putting up a fuss at the moment and somewhat advertising the locations of the bloody things.What stretch of road was this anyway? Dunno if you would have seen the Today Tonight deal on some lawyer over east (NSW afair) that keeps getting fines tossed out (usually due to faulty historys of fixed cameras).I would agree with Zap. Get as much information as you can and contest it if possible if you're sure you are innocent. Don't even know which bit that is, will be going down in a week or 2, will check it out then. Maybe that will jog the memory.I saw the TT program, coincidentally. Don't normally watch that crap any more. Usual TT story, all fluff and no real substance, but it was interesting in the circumstances.
