in events like this ,evey 1 waives the public liabilities apon entry

big signs where u get your tix , and on your tix state that motorsport is dangrous and can cause harm and /or worse ,

so I dunno where they will stand at the end of it , have a look at the todd wilkins incident a few yrs back , althoug no1 else was hurt , there was a big shake up in the way events are held and who is responsible

be4 the report was released from the investagaions , to get into EC as a competetor , I signed one form when I went to pay my money that was it , now I have to sign at the gate to cover there ass from when I go through the gate till I get to the pits and pay and sign yet again

just my 2cents worth , sorry for the spelling , to many crashes has messed my squash !

that's only for the competors not spectators you will find will be covered buy public

Liability

Rob

What hurts more CAPA'S prices or there agressive sales techniques.

If your gun'a get run over, at least it was by a cool car.

All the best to all that have been hurt. Summer Nats need to look at their events more closely anyway, sorry I don't go for burnouts (unless Im doing em) or go to woe, and who wants to pick up potatos with a stick?

It's time they cut their mullets turned off the cock rock and ran an event worth going to like the Power cruise at Easten Creek. Drifting, draging, dyno's, hard cruising and *beep*. that's worth seeing.

I saw the crash on the news and it looked like it would have hurt like hell been hit and I hope everyone is ok.. But the conditions on the back of the ticket say that condition of entry is that motor sport is dangerous and accidents can happen but upon entry no one can be held responsible for death, injury or property damage.

What happened to the armco fencing,as an event organiser you would have to be nuts not to think that at some stage a car would get out of control,a cyclone fence is no protection

Everyone knew these cars would sorta be out of control anyway :msm::laughing:

vik...where was the duty of care for the spectators,I blame the organizers!!!

There was no duty of care!!!

What idiots have spectators behind a mesh wire fence??? There wasn't even a double fence to create a no go barrier between the track & spectators.

How about concrete barrieres or water filled barriers all the way around??

Motorsport is dangerous, but in this case the organisers have made it real dangerous. I hope they get hauled through the ringers!

They're lucky no one was seriously injured or killed.

There is no way CAPA are to blame for this one!

No.

Consider if I have a sign at my door "enter at your own risk" so in you come then I murder you. Am I exempt for legal prosecution? Of course not. Clearly given that the event organisers were charging for admission then they have a duty of care to the spectators. Liability disclaimers are not worth the paper they are written on. Maybe if you made a genuine world class effort to protect the spectator, then the disclaimer might act in your favor, slightly.

In this case it looks really bad for the organisers. Expect big payout if the victims are so inclined.

Yeah I studied a little law at Uni.

I agree, wire fencing ? What were they thinking!..... I suppose the bottom line.

It was only time before something was going to happen.

Hope they continue with the Summernats, but take a bit more due care with safety of the spectators ( or at least make an effort to provide better protection ).
