This is the guts of the letter I gave to my EX boss.

I am forced to tender my resignation. My last day being 27/10/2005.

I made this decision, not because I'm unhappy with the opportunities you've presented me, but because of the fact that I fear for my safety and believe that you can no longer provide a safe working environment. This was made evident by the incident which happened yesterday at approx 4 pm when I was assaulted by another employee.

Unfortunately because of this situation, I feel that the 2 week grace period should be waived. I will therefore not be attending work from Friday 28th October – Friday 11th November.

I have reported the incident to the appropriate authorities.

Thank you very much for the opportunity to work and train at .............

Normally an employer will ask you to rethink unless they fell you're a bludger!

Basically, I told the guy not to waste my time and that he should make up for the time he mase me waste by doing over time after work. He didnt like it so he chased me down and punched me!

after much ado and comtemplating, no support or action, from authorities

I resigned and moved on ...

Bottom line, you do not have to work in a intimidating, harassing environment. If you have witnesses to this incident or people who will come forward and coroborate your story that this person is of a violent disposition or this person has had complaints bought against them in the past and nothing was done, then your boss is definately in the wrong for not addressing this employees behaviour. If however this is a 'one off event'....best of luck, sorry but if you persue it further without documented evidence the outcome you desire may not eventuate.

I would try all legal options first, as it is your employers duty of care to provide a safe working environment & he can & should be held accountable. While taking to the bully with a cricket bat may seem like a good idea at the moment, and I'm sure it would make you feel better, you will only create greater problems for yourself. You may even be able to take the matter up with Workcover/Workcare as it is an OH&S issue, and these guys are more than willing to follow up any workplace safety issues & penalise the employer accordingly. They are cracking down on workplace bullies, especially where apprentices, trainees & juniors are involved.

Go pay a lawyer $150. To draft up a technical letter indicating the incident and the action that may well be perused against the employee for the assault and the employer for not providing a safe workplace. (Lawyers are good at wording this sh!t)

They will both sh!t bricks for the simple reason the employer doesn’t want the hassles and legal costs associated with it, and the employee will sh!t co’s he wont want assault charges laid against him.

Then if all else fails do what Id do and get a handful of Bandito’s and go for a ride around to the previous place of employment and say Hello. :kissmy:

They make great debt collectors and they have a magical way of influencing people. :kissmy:

Hell they will even video the visit for an extra $100 :censored::censored:

make official complaint to police (this draw blood sh*t is sh*t)With the complaint it's now a matter of record and can be brought up at any time in the future. You also have cause for "unfair Dismissal" even though your employer didn't sack you. It has been proven in the past that if you had no choice but to leave your job because of a reason that is controlled by your employer, it is deamed to be unfairly dismissed. Before embarking down this road,consider any further ramifications regarding future employers.
