You should have whacked him back and claimed you were acting in self defence............and still proceed with all legal options...........then lay a steaming terd (make sure its a cold morning) on his bonnet. You must seek revenge in this situation, it will make you feel ten times better.

what was the work place?

office, plant, garage?

if it was an office work place, pushing and shoving should never happen, but if it was in an area such as a mechanic garage, where sometimes things can get a bit heated, there'll always be a bit of push and shove going on (especially if its a large garage)

not having a go at you at all hustler, just wondering what the workplace was.

also, good luck in getting this mess all worked out.

The banditos's venture sounds like a good action plan for me... quick, nasty and dealt with quickly. And you even get a video momento of the event! No lawyer can provide that sort of satisfaction!

Might want to consider a knee-caping option. That way the :pinch: is goin to remember you for a long time to come...

I say just move on and forget it happened. Even if the Police do treat it seriously and the guy is charged and it gets to court he will probably get off with a slap on the wrist and a small fine and told he's a naughty boy and don't do it again. Not like he's going to go to jail. He's probably still going to work at the same place and he is going to be even more pi$$ed off at being charged and is likely to want to hit you again - possibly harder and more times!

I know this all sounds harsh and unfair and you shouldn't have to put up with people like this but this is real life, and this is the way it works.

make official complaint to police (this draw blood sh*t is sh*t)With the complaint it's now a matter of record and can be brought up at any time in the future. You also have cause for "unfair Dismissal" even though your employer didn't sack you. It has been proven in the past that if you had no choice but to leave your job because of a reason that is controlled by your employer, it is deamed to be unfairly dismissed. Before embarking down this road, consider any further ramifications regarding future employers.

Turtle is correct but I agree with Falchoon, would you really want to work there even if mr punchy britches was sacked? In the mining industry (where I work) if there's a punch thrown they don't ask questions, they just sack BOTH people involved.

Yep as Falchoon has already said unfortunately life has a habit of dealing up some no win situations.

If you didn't respond physically the first time you obviously have your reasons so I wouldn't be looking at any form of retribution, unless you can lay the first and last blow that is, which will more than likely see you being the one in trouble with the law.

As for recourse against your ex-employer. Ideally you would have needed to put your concerns in writing and given him a chance to take steps to minimise a repeat occurance in the future before resigning.

Also as wrong as it sounds the lack of any blood, swelling or noticable injury will make it hard for you to get anyone to take it too seroiusly except a lawyer of course that will be prepared to take it up with the Pope if your willing to shell out the cash.
