Epa (nsw) Defect Notice

Here's an update after phoning EPA...

Detected by an EPA officer near where I work.

How? not with sophisticated equipment...

He could hear it from inside his car when the radio was on low.

Very technical, hey!

Mind you they said he is a very senior officer & knows a lot about cars. What a load of BS.

Rang Ford, they cant even tell me what the noise level should be based on their testing.

Write a letter stating that the car is standard and that as far as you know, some geriatric dude's ear is not a NATA certified and calibrated test instrument. Say that you are willing to contest the fine in court. They don't have a leg to stand on and probably hoped you'd just turn turtle and pay the fine. Get the test done if you get a summons otherwise, don't waste your money.

I like the suing idea by turbo6man. Take the bar$tard to court cos its bull$hit. Ive taken a cop to court before over a driving offence and it only cost an extra $70 on top of my fine. I had a good case but didnt win despite the cop stuffing up and saying I was driving a different car and was pulled over on a different street?? All depends on the judge, but definately pursue it just to pi$$ him off.

How unproffessional, as said it is not your job to prove adr compliance on a stock car.

I would write letters to him and his superiors, and let them know you'll be having the matter heard in court and you will be seeking compensation for money and time lost.

I know of may people who have been receiving the EPA letter in the mail.

Did you drive in the Sydney CBD on a Friday or Saturday night or any of the street racing hangout spots ?

Apparently the cops and EPA are taking rego's down and sending letters out to car owners.

You should not have to go to the EPA or RTA, most exhaust shops can give you the approval to clear this defect.

If not you will be asked to do a driveby test that will be done at the EPA place at either Penrith or Rookwood.

It does suck getting done, I would send an invoice tot he EPA for the trouble caused by having to clear a stock car.

Hey Zap.

The car was "detected" 9am on the way to work at Padstow (for those who know it)

I have to take it to Rockwood to have it cleared according to the EPA, but I will look into your suggestion & contact some exhaust shops.

Feel like writing some abusive letters now you guys are firing me up. Where will I start?

Hi Guys

Found a surprise in the mailbox yesterday.

Would you beleive it, a defect notice for exhaust noise.

First, no explanation of who, how, where it was measured.

Second, exhaust is total stock. 2003 Turbo

Now I'm expected to prove my innocence by having the car tested.

I thought it was innocent until proven guilty, not the other way around.

If it is proven excessive, Ford have a lot of cars out there to be worried about.

Has anyone there had any experiences like this? Your feedback would be appreciated.

if the car is stock, it is a FoMoCo problem, not yours !! 

not your role to prove ADR compliance on a factory standard car

good luck and make as much NOISE as you can

Well actually it is his problem as of right now as he was the owner and driver of the car, not FoMoCo.

And, unfortunately he does have to prove compliance because that is how the law is written.

THEN, if it is clear he goes for the EPA officer and if it's not he goes for Ford.

PS ... If every person who got one of these defects (in error) were to write to his local member then something might get done about changing the law. BUT most cars that get the defect deserve it, so there isn't much of a leg for the few innocents to stand on.

It's not a fine - it's a defect notice and there is no way of taking it to court as it is not a defencable issue.

What has to be done is to comply with the notice, and then take civil action in court by way of a summons against the person for wilful misuse of his authority or something similar.

Or just move to where the speed is open and the noisey cars roam free.
