Hey Zap,

I only had 1 number plate stolen as well. Must have been a souvener hunter I guess? I didn't think so either but the Police said to push the issue with the RTA and I could get them remade as there is no rule otherwise. The only problem is that the numberplates will always be listed as stolen on the Police computer. When they pulled me over for the RBT the other day they didn't kick up any fuss so I doubt the police are to worried about it.

I don't know if this is directly related Dallas, but recently in Grafton a boy was a passenger with a (drunk) mate and they were doing donuts (or similar) in a local park and the driver lost control and rolled down a slope. Passenger died.

The driver has actually been sent to Jail as an 'Example'

A park? Was it on a public road? Or did he run off the road into a park? If he wasn't on a public road he can't be charged with that offence. But there are still other offences he could face so ... it's a no win situation for him I'm afraid. As for the penalty, in NSW it would be three months cancellation but who knows in QLD???

<{POST_SNAPBACK}>

Turbo6man, generally, far as I have noticed, you give fairly good and acurate advice. However in this instance I have to disagree. The Road Safety Act is an act adopted then modified by every state to suite their own needs. You can be charged with offences under the Road Safety Act when on a "highway". A highway is defined as a "road or road related area". If this is looked up people may be surprised by what a "road related area: covers, and these days the definition in saome places streches the wording of the act too.

Lumpy, your example is Culpable Driving. That's one step below murder, VERY different. The offence described here is called Careless Driving in Victoria and it is, sort of, one step above a burnout.

I have charged people with Careless Driving before and penalties have ranged from a 6 month Suspension of licence and a small ($400.00) fine to a 12 disqualification of licence and a $1200 fine. There are no provisions under the act for a term of imprisionment though (As far as I know. Not 100% on the last point).

I know a guy who's just gone to court here in QLD for the same offence. 'Driving with Undue Care and Attention.'

Clean record, no previous. $250 fine. That's it.

Dallas,

You may be best to call the local highway patrol to find out.

Its best to know from the right sources as I would say it will be serious

<{POST_SNAPBACK}>

come on you were 17 once too.

I sugest he get good representation. How is his previous record? Was he drinking? He has his age on his side. The least he will get is 3 months suspension. If its not drink driving as well he should be in that much :glad:

He should of got his mates to disappear from the accident without passengers he would of been treated more leniently. I think??

Cant agree with you more .... having a legal background helps a little too but Ive gotten out of 2 parking fines because of the wording in the act ....

A highways is a street, road, avenue, court, grove .... etc etc etc but doesnt say anything if the street is named ends in something else ....

I'm guessing that this is different in each state. I got done for one of the things you've listed there, but didn't get any demerrit points, only got a fine.
