tuffxr6 Member 104 Member For: 20y 11m 25d Location: goldcoast Posted 19/02/05 02:57 PM Share Posted 19/02/05 02:57 PM About an hour a ago I just got issued a $700 fine and a lost of licence for 6 months for apparantly eceeding 40kms over the speed limit(150 in a 110 zone).Me and my mate where cruising home from surfers when my mate wanted a run(knownly I didnt stand a chance)so I gave him a squirt and when I was doing about 140km/h he was about 4 car lenghts ahead of me so I braked and backed off, he kept speeding off,and then in my rear view mirrow I see cop lights flashing(thought to my self im getting a nice fine here)so I pulled over and my mate ahead pulled over also.The cops firstly walked to my mates car and talked to him for a couple of minutes then walked to my car and said "so mate what speed did you think you where doing"without producing a radar gun I reply "about 140km/h"the cop then said"you have two choices tell us you where doing more than 150km/h and we will just issue you with a fine or not tell us you where doing that speed and we will take your car put it in impound for street racing and you will have to pay for all the towing fees and a fine as well"so I replyed "officer im telling you the truth I was doing 140km/h" the officer then took my car keys and sat in his car for about 15 minutes.He finally returned with my keys and said we are not impounding your car tonight but we are issuing you with a $700 fine and a lose of licence for 6 months for exceding 40kms over the limit which is automatic lose of licence, I replyed "I wasnt doing 40kms over the limit I was doing 140 in a 110 zone which is 30 over the limit(30km/h over the limit isnt lose of licence)"the officer replyed we didnt get you on the rader but we where doing 140km/h and you where pulling on us hard if you have a dissagrement on the fine you can take it to court".The cops then handed me the fines and left. The way the cops handeled this situation was totally unfair and they are oviously annoyed with the car scence going on at the gold coast and they are happy to see any performance car off the road.My mate got fined more than me and at 180kms an hour because he ammited to doing that speed,they also filled the fine out like this Your speed of ^150 km/h exceeded the maximum speed limit of 110km/h.This could mean I was doing 300km/h,any one with any legal advise would be greatly appreciated.Peter. Unfortunatly they'll look at your record ( what's it like?? ) how many points you have lost etc. If your relativley clean, well maybe you have a slim chance.. But I dunno.. I'm just thinking, did that cop attempt to blackmail you?? sounds like it...... Do not go without one. Its worth the money. The court doesnt like people defending themselves as I found out before Christmas. The Ba#tards extended my suspension to a disqualification for an extra 3 months. Also sit down now and write EVERYTHING down in order and who said what. It is important while it is still fresh in your head. Do not BS as the cops will also have everything written down.Find out if you were video'ed by the cops.Make sure you also note how long the cops were behind you, the fact they did not get you on radar and that they said you were pulling away from them smells like they never got an accurate reading. If you have a really bad driving history, I do not like your chances, but getting a good legal person may make the difference.Also get your friend to do the same. Just because he admitted to the speed does not make it an open and shut case. The cops were intimidating you by threaqtning you with a worse offence if you did not admit to another charge.Good luck. I'm just thinking, did that cop attempt to blackmail you?? sounds like it......<{POST_SNAPBACK}>My driving record is good my last speeding offence was easter two years ago(90 in a 80 zone).The cops where trying to bribe me into saying I was doing more than 150km/h,they told me I had two options admit I was doing more than 150km/h and just get a fine or dont admit to doing more than 150km/h and we will tow your car,put you down as a queensland street racer and you will pay a bigger fine and tow truck fees also. The cops were intimidating you by threaqtning you with a worse offence if you did not admit to another charge.Good luck.<{POST_SNAPBACK}>When I gave my mate a bit of a run I saw a car about 1km away(which was the cop car)So when we had a bit of run they where about a 1 km behind, they would of suspected something ahead as my mate was shooting 5 foot flames out of his exhaust.I was talking to my parents this morning and im using there solictor for the matter,I hope we are vido'ed as the cops where doing all the yelling and trying to use scare tactics to get a confesion out of me and when I didnt give them a confesion they wernt exactly friendly,but at the end of the day I was only doing 140 km/h the police have no evidence what speed I was doing, they pushed a fine on me that I was exceeding 40km over the limit so I would lose licence, I had a friend in the car also to confirm I was only doing 140km/h. Hope they pinged your mate as well.<{POST_SNAPBACK}>yes I was street racing I admit that and I am prepared to do the time,and the crime was 30km/h over the spped limit which is a fine and no lose of licence,but they tried to pinch me for doing more than 40km/h over the speed limit which is a bigger fine and lose of licence for 6 months I cant afford to lose my licence as driving is a big role of my job(yes I know if cant afford to lose my licence why was I street racing).Did you read all the thread mate, if you want to start flaming people keep posting on the rwkw and injector threads.
