Hey all,

got done today speeding. SS driver pulled me over.

Was ok and booked me lower than he should have.

A question for you: if he makes mistakes on the ticket, is that reason enough to get off?

He made 2 mistakes:

1) Got my license number wrong

2) Got my car type wrong (wrote Commodore).

Im not sure if that's reason enough...anyone know?

I would be thinking that if he got the details of the car wrong it would mean you should have to pay the fine...

ill be wanting to know the answer to this also, as that when I was done for speeding a while back the ticket I got wasnt signed by the policeman... I still had to pay it even if it was my first offence...

in your case I think you will have to show some kind of proof that it was not your car / rego that was written on the ticket...

I'd say you have good grounds for getting off.

The catch is that you could have to go to court to play your trump cards and, at that stage, the magistrate has a fair bit of discretion. Could go either way.

Personally, I'd probably try to get a reprieve before it gets to that stage. Write in and say something like "I was reported but there seems to be a fair bit of confusion about the details of the alleged offence. If the car type and rego are wrong, isn't it likely that other details (eg the alleged speed) are also wrong? Indicate that you are willing to go to court if necessary.

My bet is that they would prefer to avoid going to court with such obviously flawed evidence and will give you a "get out of gaol free" card.

I'd just want to play the cop's mistakes for all they're worth as it seems like a potentially lucky break.

But, I'm not a lawyer so I wouldn't really know.

I had a speeding ticket where they got the color, make, and type of my car wrong, the cop even got my name wrong, I took it to the court house and they said to go to the police station to get it all sorted out there, the office at the front desk says just wait here a while. 20 minutes later comes out and says heres your new ticket you have 28 days to pay the fine. Its pretty hard to get out of paying fines I know a few people apart from me who have tried and they all got reissued new tickets.

I assume from some of your other posts you are Victorian.

If you want to use those as grounds to get out of paying your fine, its off to court.

Once you are there, all sh*t aside, it comes down to whether a professional witness like the policeman can convince the magistrate there was a reason for the error.

If there was another reason to fight it and this was a side issue, I'd say yes, you had a reasonable chance, but with this as your only line of defence, personally, I wouldn't waste my time.

The policeman will get up and offer his well rehearsed evidence deatiling the intricate details of how to operate a radar/laser speed measuring device. The type of vehicle has no bearing on proving te offence other than your partially contributing to your ID. You would need to try the defence that it was not you driving the vehicle. Do you think you could get away with that in a court? If not, as I said, the type of vehicle has nothing to do with it.

He has already done you a favour by writing down the speed, so why :spoton: in his face? Not a personal attack, but on that defence, if he is even moderately capable of executing his duties, he will win, and you'll be out of pocket.

If he got your licence number wrong, couldn't you just not pay it? They will chase whoevers licence number that is?

I was going to say this also, but I am assuming he got your rego correct? Are you the registered owner?
