I understand that as his team breached the rule with regard to the ECU, some penalty must be imposed, but the penalty you have chosen is outside your own guidelines. I'm a bit puzzled how B 7.3 has been appropriately applied here; the clause states:7.3.1 The Stewards must have regard to the most appropriate penalty or penalties and should take into account the following factors in assessing any penalty to be imposed:7.3.1.1 whether the offender made an early admission of a breach of the Rules or whether the Stewards found against them following an inquiry,7.3.1.2 the seriousness of the offence,7.3.1.3 whether the offender gained any advantage;7.3.1.4 whether the offence resulted in a disadvantage to another person;7.3.1.5 if the offender is a member of a multi-Car team, the Stewards must consider whether the offence was committed to assist an other team member to gain any advantage.7.3.1.6 any other aggravating or mitigating factors,7.3.1.7 the specific maximum and, if specified, the minimum penalties in theSchedule B 4 Tables and any Further Penalties,7.3.1.8 in considering the penalties of fines and loss of series’ points (“points”), the Stewards must take into account the standing of the driver in the relevant series points score; and where the driver is:(a) in the top twenty of the points score, must firstly consider a penalty ofdeducting points; and(b) not in the top twenty of the points score, must firstly consider a penaltyof a fine; and7.3.1.9 any previous breaches of the Rules, whether or not such breaches appear in the offender’s Pass Book/Licence.The table of penalties referred to (B 4) lists 85 as the maximum points deduction (and a $15,000 fine) for a technical breach that is deemed not intentional.If the maximum penalty is 85 points, how did CAMS come to a decision to impose a penalty that is approximately 2.3 times that value (192 points)? Especially as SBR admitted the breach, and admitted that it was unintentional, and CAMS found that it did nothing to aid performance - in fact the plug in question was not plugged in to anything. Also, with regard to breaches by other drivers, I understand that PWR Racing was found to be in breach of the Rules, in that at the end of Race 1 at the Clipsal 500, post race scrutiny revealed that the Control ECU Loom was not in compliance with the Rules. A penalty of $1,000 was imposed. Also, Car #28, Matthew White, was found to be in breach of the Rules, in that at the end of Race 1 (Clipsal 500), post race scrutiny revealed that the Control ECU Loom was not in compliance with the Rules. Stewards imposed a reprimand.So we have 3 breaches of the ECU rule:1. PWR - $1000 fine2. M White - reprimand3.
