we are also getting a killer deal for it:

19's instead of 17's

drive away for $41,500. A $7000 discount, made the car look alot more attractive. But I also agree and so does the Expensive Daewoo dealer (a friend) that the T has it to 100km/h

From what I have read in this post it appears that if you mod your car to the hilt and it is still RTA legal, Ford will honor your warranty if you don't "race" your car. Is this a correct comment or not?

I somehow REALLY doubt this would be the case as there are many things you can do to a car (APS stage 3) that the RTA would pass, yet Ford would not warrant

I think what people are forgetting is that any failure must be proven to be a result of any mods made. Ie I worked in computer retail and we were told that if you used non geniune ink in certain printers that they would not be covered by warranty, this was challenged by consumer who purchased aftermarket ink at the end of the day the manufacturers could not prove failure as a result of the aftermarket ink and had to cover and withdraw there statement of not covering printers that used after market ink if the ink was not responsible for the failure. Again ford Expensive Daewoo toyota etc tried to inform that if car was not serviced by them that you would lose your warrant however you can take your car to ultra tune,repco whoever you like so long as the car is serviced at the correct intervals and no negligence is shown by your mechanic ford have to honour any warranty repairs. Now getting back on track Just because ford put out a disclaimer stating that they will void warranties to scare the comon person I would still like to see how it would holdup in court if someone who didnt care about the money were to go thst way to prove a point.Big companies will always flex there muscles. I`m not saying to go blow up your cars but for ford to say if they see your car on a race track they will void your warranty. I think they are using scare tactics.

my 2 cents by the way my car is completely stock at the monent anyway

The problem is this tactic will work with about 95% of people. The other problem is to fight a denied claim would usually cost you more than the cost to fix the problem. While I know what you are saying is correct, it comes down to a bluff from Ford and very few people will call a bluff from a big multinational.

Also it would not take a geinus to prove that an APS phase 3 kit would cause increased damage to a diff if it was claimed on warranty.

This site will hopefull prevent any of our members being bluffed.

I think what people are forgetting is that any failure must be proven to be a result of any mods made.

My understanding is that the onus lies on the owner to prove that the mods didn't cause the problem.

no that is what Ford would like you to think. Consumer laws are on the customers side. Ford would need to prove that a mod directly caused the problem that will not be covered by warranty.

I dont see how a consumer can win. If you fit a phase 3 kit to your xr and blow your diff ford is obviously going to say that the phase 3 is the culprit, you would have a harder time trying to prove it wasnt the case than ford would proveing it was, even if the diff was faulty out of the factory.

Wouldnt ford just say, "if the car was supposed to have that much power it would have when you bought it." I know that's a load of sh*t but a load that's very much in fords favour.

I am not saying that as a consumer you could fit a phase 3 kit and expect warranty on the drivetrain....but....if you had a phase 3 kit and your power windows failed, and Ford would not fix it under Warranty,Ford would have to prove that the phase 3 kit caused the problem. This would be impossible to prove as the phase 3 kit has nothing to do with the windows, but if you got aftermarket tint that was 5mm thick and the tint caught on the windows rubbers and jammed the windows causing the power window motor to burn out, this would void the warranty on the power windows.....but if Ford had fitted the tint it would be under warranty......does all this make sence ?

Australian consumer laws are great if you know how to use them. :banghead:
